While these Terms govern your general use of our website and platforms, specific client projects are governed by individual Statements of Work (SOW) and accompanied Contracts.
Acceptance Criteria: Unless otherwise specified, clients have 5 business days to review and approve deliverables; lack of response within this period constitutes deemed approval.
Project Dormancy: If a project remains inactive for 21 business days due to a lack of client response, it will be considered dormant and may be subject to restart fees equal to the project’s list price.
Client Responsibilities: Clients are responsible for providing necessary access to platforms, content, and timely feedback to maintain project schedules.
Our services frequently integrate with or build upon third-party applications and AI models to deliver elevated digital experiences.
Service Integrations: We utilize platforms such as WordPress, Shopify, Elementor Pro, N8N, Stripe, Webhook API’s to build and automate systems.
AI Models: Our AI services and workflows utilize models from various providers, including OpenAI, Anthropic, Google Generative AI, Microsoft Azure, and Perplexity, among others.
Analytics Tools: We use with Google Analytics, Microsoft Clarity, PostHog, to capture behavioural metrics and optimize digital experiences.

To access certain features, such as our Partner Hub or Client Hub, you may be required to register an account. You are responsible for maintaining the confidentiality of your account credentials and restricting access to your devices. The Service must not be used for any unlawful or unauthorized purpose.
Virtually Creative Inc. and its licensors retain all intellectual property rights to the Service, including our website design, original content, and branding. Your use of the Service grants you no rights to use Virtually(Creative)’s trademarks, logos, domain names, or other brand features without permission.
Information exchanged under these Terms must be treated as confidential, and neither party shall disclose such information without the prior written consent of the other. You agree to indemnify, defend, and hold harmless Virtually(Creative) and its affiliates, officers, agents, employees, and partners from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your breach of these Terms, your improper use of our services, or your breach of any law or the rights of a third party.
We reserve the right to modify these Terms at any time. We will provide notice of significant changes, and your continued use of the Service constitutes your agreement to the revised Terms. We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms.
These Terms are governed by the laws of the Dominion of Canada. Any disputes arising from these Terms will be resolved through arbitration or in the court jurisdiction of Ontario, Canada.
