Statement of Work - Accessibility Consulting

A comprehensive plan to ensure your digital experience is inclusive and compliant.

By agreeing to this Statement of Work (SOW), both parties consent to the terms and conditions outlined herein and in the accompanying “Contract” specific to your project, pertaining to the Services to be performed under this SOW.

Term

This SOW commences on the subscription, payment, or acceptance date specified in your invoice or scope request and continues until all services are performed and deliverables provided by Virtually(Creative), unless terminated earlier per the Contract. Expiration or termination of the Contract does not terminate this SOW; all applicable terms and conditions of the Contract remain in effect until this SOW concludes.

Project Description

Virtually(Creative) provides Accessibility Consulting Services to help businesses comply with AODA (Accessibility for Ontarians with Disabilities Act) and WCAG 2.1 (Web Content Accessibility Guidelines) standards.

This service includes three key deliverables, each designed to ensure an inclusive and legally compliant digital presence:

1.Web Assessments for AODA Violations – Conducting a comprehensive audit of a client’s website to identify compliance gaps.

2.Action Plan to Become WCAG 2.1/AODA Compliant – Developing a strategic roadmap to remediate identified violations and achieve compliance.

3.Training Your Next Accessibility Champion – Equipping an internal team member with the skills to maintain accessibility long-term.

Each package includes specific deliverables detailed in the Scope of Services below.

Scope of Services

Web Assessments for AODA Violations ($1,250+ per Audit)

An in-depth accessibility compliance audit to identify AODA/WCAG 2.1 violations.

Automated & Manual Testing

•Utilize industry-standard tools (axe, WAVE, Lighthouse) for automated scans.

•Conduct manual audits for screen reader compatibility, keyboard navigation, and visual accessibility.

Accessibility Compliance Report

• Deliver a detailed breakdown of all violations categorized by severity (Critical, Major, Minor).

•Provide screenshots, descriptions, and impact analysis for each issue.

Review & Consultation Call

•A 1-hour consultation to walk through findings and recommendations.

•Address client questions regarding compliance steps and legal exposure.

Action Plan to Become WCAG 2.1/AODA Compliant ($2,750+ per Implementation Strategy)

Guided remediation planning to ensure full accessibility compliance.

Prioritization of Violations

• Categorize issues based on legal urgency and business impact.

•Provide quick-fix solutions for immediate compliance needs.

Step-by-Step Compliance Roadmap

•Develop a phased plan for short-term, mid-term, and long-term accessibility improvements.

• Assign responsibilities between client-side developers and Virtually(Creative)’s accessibility specialists.

Implementation Support & Technical Advisory

•Provide technical guidance on fixing code-level accessibility issues.

•Offer direct remediation services for complex accessibility fixes (upon request).

Progress Tracking & Final Compliance Check

•Conduct regular follow-ups to ensure remediation efforts are on track.

•Perform a final audit after all fixes are implemented.

Training Your Next Accessibility Champion ($1,850 per Training Program)

Developing in-house expertise for long-term accessibility maintenance.

Customized Training Curriculum

•Tailored accessibility training program designed around the client’s industry and needs.

• Covers WCAG principles, best practices, and compliance workflows.

Hands-On Testing & Implementation Exercises

• Live screen reader usage demonstrations and keyboard navigation tests.

• Practical exercises to identify and remediate common accessibility issues.

Certification & Ongoing Support

•Issue certification of completion for the trained Accessibility Champion.

•Provide ongoing support for 3 months, including accessibility updates and Q&A sessions.

Accessibility Maintenance Plan (Optional Add-On)

For businesses committed to long-term accessibility compliance, Virtually(Creative) offers an Accessibility Maintenance Plan to ensure ongoing WCAG 2.1/AODA compliance as websites evolve over time.

This add-on service is available after completing the initial accessibility remediation process and is designed to prevent accessibility issues from resurfacing due to website updates, content changes, or new platform integrations.

Standard Accessibility Maintenance Plan ($650/month)

Quarterly team training refreshers on accessibility best practices.

Enterprise Accessibility Compliance Plan ($2,750+/month, Custom Pricing)

For larger businesses or organizations needing full accessibility oversight and legal compliance assurance.

Includes everything in the Advanced Plan, plus:

Dedicated Accessibility Consultant

•A named accessibility expert assigned to oversee compliance.

•Monthly 1:1 strategy sessions for long-term accessibility planning.

Legal Compliance Assistance

•Preemptive review of policies and legal documentation to support AODA/WCAG adherence.

• Assistance in responding to accessibility complaints or audits from regulatory bodies.

Custom Accessibility Enhancements

• Regular usability testing with individuals who rely on assistive technologies.

Add-On Plan Terms & Conditions

•Maintenance plan is billed monthly and requires a minimum 3-month commitment.

•Hours do not roll over—unused monthly consultation time resets at the end of each billing cycle.

•Clients must provide advance notice of major website changes to allow time for accessibility adjustments.

•Plans may be customized for organizations with specific compliance needs.

Project Workflow & Implementation

1) Kick-Off & Accessibility Evaluation

1-hour discovery call to define compliance goals and website requirements.

•Gather access to necessary platforms for assessment and implementation planning.

2) Accessibility Audit & Action Plan Development

•Conduct full website audit for WCAG 2.1/AODA violations.

• Present a comprehensive report with categorized issues and remediation roadmap.

3) Implementation & Monitoring

• Implement compliance updates (client-side or with Virtually(Creative)’s direct assistance).

• Monitor improvements and validate accessibility fixes.

4) Accessibility Champion Training & Handoff

•Deliver custom training sessions and certification program.

• Provide access to resource materials for ongoing learning.

Kick-off Requirements:

To initiate the project, the following are required:

Approved decision-maker(s).

Signed Contract.

First payment processed.

Scheduled kick-off call.

Timeline Adjustments:

Delays caused by revisions or missed deadlines will necessitate a revised timeline based on Virtually(Creative)’s availability. Additional charges may apply.

Acceptance Criteria

Approval Period:

Clients have 5 business days to review and approve deliverables. Lack of response within this period constitutes approval (“deemed approval”).

Assumptions and Dependencies

All services are provided remotely.

Clients are responsible for providing necessary website access for audits and remediation.

Timely feedback and approvals are essential to maintain the project schedule.

Customer Responsibilities

To ensure a smooth workflow and timely delivery, clients are responsible for:

Providing website access credentials for accessibility audits.

Implementing recommended fixes (if not performed by Virtually(Creative)).

Designating an internal team member for accessibility champion training.

Dormancy & Restart Fees:

If a project is inactive for 21 business days due to lack of client response, it will be considered dormant and may be subject to restart fees equal to the project’s list price.

Compliance & Legal Considerations

AODA & WCAG 2.1 Compliance Standards

Virtually(Creative) follows best practices in accessibility compliance but cannot guarantee protection from legal action or regulatory fines if compliance is not fully implemented by the client.

Statement of Accessibility Improvements

Upon completion of the project, Virtually(Creative) will issue a formal statement documenting compliance improvements made to the website, which may be used for internal records or legal documentation.
